1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Peblio's communication platform ("Service") provided by Peblio Ltd ("Company", "we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you are entering into this agreement on behalf of a childcare provider, school, or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of Service

Peblio is a secure communication platform designed specifically for childcare providers, including:

  • Secure messaging between staff and parents
  • Announcement and notification system
  • Photo and video sharing with consent management
  • Event and calendar management
  • Read receipt tracking
  • Compliance and safeguarding tools
  • Billing and subscription management

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 User Roles and Permissions

Our Service supports different user roles with varying permissions:

  • Staff: Can send messages, create announcements, and manage events
  • Managers: Have administrative access and can manage user permissions
  • Parents: Can receive communications and respond to messages
  • Extended Family: Limited access as designated by parents

4. Acceptable Use Policy

4.1 Permitted Uses

You may use our Service only for lawful purposes and in accordance with these Terms. You agree to use the Service for:

  • Legitimate childcare communication and administration
  • Sharing educational and developmental information about children
  • Coordinating events, activities, and important announcements
  • Maintaining compliance with safeguarding and regulatory requirements

4.2 Prohibited Uses

You agree not to use our Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code
  • To collect or track personal information of others
  • To spam, phish, pharm, pretext, spider, crawl, or scrape
  • For any obscene or immoral purpose
  • To interfere with or circumvent the security features of the Service

5. Content and Intellectual Property

5.1 User Content

You retain ownership of content you create, upload, or share through our Service ("User Content"). By using our Service, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your User Content solely for the purpose of providing our Service.

5.2 Our Intellectual Property

The Service and its original content, features, and functionality are owned by Peblio and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.3 Children's Content

Special care must be taken with content involving children. You must obtain proper consent before sharing photos, videos, or personal information about children. We reserve the right to remove any content that violates child protection guidelines.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We are committed to complying with applicable data protection laws, including the UK GDPR and Data Protection Act 2018, particularly regarding the processing of children's personal data.

7. Safeguarding and Child Protection

All users must comply with applicable safeguarding and child protection requirements:

  • Maintain appropriate professional boundaries
  • Report any concerns about child welfare immediately
  • Ensure all staff have appropriate background checks
  • Follow your organization's safeguarding policies
  • Respect children's privacy and dignity

We reserve the right to suspend or terminate accounts that violate safeguarding requirements or pose a risk to children's welfare.

8. Billing and Payment Terms

8.1 Subscription Fees

Subscription fees are based on your organization's size and selected features. Current pricing is available on our website and may be updated with 30 days' notice.

8.2 Payment Terms

  • Fees are billed monthly or annually in advance
  • Payment is due within 30 days of invoice date
  • Late payments may result in service suspension
  • Refunds are provided according to our refund policy

8.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.

9. Service Availability and Support

9.1 Service Level

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may perform scheduled maintenance with advance notice.

9.2 Support

Technical support is available during business hours (9 AM - 5 PM GMT, Monday to Friday). Emergency support is available for critical issues affecting child safety.

10. Limitation of Liability

To the maximum extent permitted by law, Peblio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Peblio and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any User Content you submit or transmit through the Service

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

13. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before pursuing legal action, we encourage you to contact us to resolve any disputes through good faith negotiations.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
